These Terms & Conditions (“Terms”) govern Your access to and use of the Guardian Gear website, articles, guides, systems, and related content (collectively, the “Service”). By accessing or using the Service, You agree to be bound by these Terms. If You do not agree to these Terms, You must not use the Service.

For purposes of these Terms:

Guardian Gear does not warrant that the Service will be uninterrupted, secure, or free of errors or harmful components, nor does Guardian Gear warrant the accuracy, completeness, or reliability of any content. You use the Service at Your own risk.

Guardian Gear makes no warranties regarding products offered or sold through Wed2C or any other third-party platform. Any product warranties, guarantees, or representations are provided by the relevant platform, supplier, or manufacturer, not by Guardian Gear.

Limitation of Liability

To the maximum extent permitted by law, Guardian Gear, J K Collins & Associates LLC, and their officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to Your use of or inability to use the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, Guardian Gear’s total aggregate liability for any claim arising out of or related to the Service or these Terms will be limited to the greater of: (a) the amount You actually paid to Guardian Gear (if any) for accessing the Service in the twelve (12) months prior to the event giving rise to the claim; or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to You to the extent prohibited by law. In such cases, Guardian Gear’s liability will be limited to the minimum extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Guardian Gear, J K Collins & Associates LLC, and their officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any law or the rights of a third party;

Governing Law

These Terms and any dispute arising out of or related to the Service or these Terms will be governed by and construed in accordance with the laws of the State of Hawaii and the United States, without giving effect to any conflict of law principles that would require the application of the laws of another jurisdiction.

Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including alleged breach, termination, enforcement, interpretation, or validity) will be resolved exclusively by binding arbitration, rather than in court, except You may assert qualifying claims in small claims court in Hawaii if they meet that court’s requirements.

The arbitration will be conducted in the State of Hawaii by a single arbitrator, under rules reasonably consistent with applicable arbitration procedures. The language of the arbitration will be English. The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

You and Guardian Gear agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.

If any part of this arbitration section is found to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

International Use

The Service is primarily directed to users located in the United States. If You access the Service from outside the United States, You do so on Your own initiative and are responsible for compliance with local laws.

Guardian Gear does not represent that the Service or any content is appropriate or available for use in all locations. Access to the Service from territories where the content or activities described are illegal is prohibited.

Changes to These Terms

Guardian Gear may update or modify these Terms from time to time. When changes are made, the “Last updated” date at the top of this page will be revised. Where appropriate, Guardian Gear may also provide notice by email or a notice on the Website before changes become effective.

Your continued use of the Service after changes to these Terms become effective will constitute Your acceptance of the updated Terms. If You do not agree with any changes, You must stop using the Service.
